Terms of Service

この利用規約（以下「本規約」）は，Tsubakurame（以下「当社」）がこのウェブサイト上で提供するオンラインショップ（以下「本サービス」）の利用条件を定めるものです。
These Terms of Service define the conditions for using the online shop (the "Service") provided by Tsubakurame ("the Company") on this website.

第1条（適用）/ Article 1 – Applicability

本規約は，お客様と当社との間の本サービスの利用に関わる一切の関係に適用されます。当社は本規約のほか，各種の個別規定を設けることがあり，これらは本規約の一部を構成します。個別規定と本規約が矛盾する場合，個別規定が優先されます。
These Terms shall apply to all relationships between the Customer and the Company regarding use of the Service. The Company may establish Individual Provisions, which shall constitute part of these Terms. In the event of contradiction, Individual Provisions shall take precedence.

第2条（売買契約）/ Article 2 – Sales Contract

本サービスにおいては，お客様が購入の申し込みをし，当社が承諾の通知をすることによって売買契約が成立します。商品の所有権は，当社が配送業者に引き渡したときにお客様に移転します。
A sales contract is formed when the Customer applies for a purchase and the Company notifies acceptance. Ownership of the product transfers to the Customer when the Company hands the product to the delivery service provider.

以下のいずれかに該当する場合，当社は事前通知なく売買契約を解除できます。
The Company may cancel the contract without prior notice if:

• お客様が本規約に違反した場合 / The Customer violates these Terms.
• 届け先不明や長期不在により配送が完了しない場合 / Delivery cannot be completed due to unknown address or long-term absence.
• その他，当社とお客様の信頼関係が損なわれたと認める場合 / The Company otherwise determines that trust has been damaged.

第3条（知的財産権）/ Article 3 – Intellectual Property Rights

本サービスによって提供されるコンテンツの著作権その他の知的所有権は当社に帰属します。お客様は，無断で複製・転載・改変・その他の二次利用をすることはできません。
All copyrights and intellectual property rights of content provided through the Service belong to the Company. The Customer shall not reproduce, reprint, modify, or otherwise make secondary use of them without permission.

第4条（禁止事項）/ Article 4 – Prohibited Acts

お客様は，本サービスの利用にあたり，以下の行為をしてはなりません。
In using the Service, the Customer shall not:

• 法令または公序良俗に違反する行為 / Acts that violate laws or public order and morals.
• 犯罪行為に関連する行為 / Acts related to criminal activity.
• 知的財産権を侵害する行為 / Acts that infringe upon intellectual property rights.
• 当社のサーバーまたはネットワークを妨害する行為 / Acts that destroy or obstruct the Company's server or network.
• 本サービスによって得られた情報を商業的に利用する行為 / Commercial use of information obtained through the Service.
• 不正アクセスをし，またはこれを試みる行為 / Unauthorized access or attempts to do so.
• 他のお客様の個人情報を収集または蓄積する行為 / Collecting or accumulating personal information about other Customers.
• 他のお客様に成りすます行為 / Impersonating other Customers.
• 反社会的勢力に対して利益を供与する行為 / Providing benefits to anti-social forces.
• その他，当社が不適切と判断する行為 / Other acts the Company deems inappropriate.

第5条（本サービスの提供の停止等）/ Article 5 – Suspension of Service

当社は，以下のいずれかに該当する場合，お客様に事前に通知することなく本サービスの全部または一部の提供を停止または中断することができます。
The Company may suspend or interrupt the Service without prior notice if:

• コンピュータシステムの保守点検または更新を行う場合 / Performing maintenance, inspection, or updating of the system.
• 地震，火災，停電などの不可抗力により提供が困難となった場合 / Force majeure such as earthquake, fire, or power outage.
• コンピュータまたは通信回線等が事故により停止した場合 / Accidental stoppage of computers or communication lines.
• その他，当社が提供困難と判断した場合 / The Company otherwise determines provision is difficult.

当社は，本サービスの停止または中断により，お客様または第三者が被ったいかなる損害についても一切の責任を負いません。
The Company shall not be liable for any damages suffered due to suspension or interruption of the Service.

第6条（保証の否認および免責事項）/ Article 6 – Disclaimer

当社は，本サービスに事実上または法律上の瑕疵がないことを保証するものではありません。当社は，本サービスによってお客様に生じたあらゆる損害について，一切の責任を負いません。
The Company does not guarantee that the Service is free from defects. The Company shall not be liable for any damages incurred by the Customer through the Service.

第7条（サービス内容の変更等）/ Article 7 – Changes to Service

当社は，お客様に通知することなく，本サービスの内容を変更しまたは提供を中止することができ，これによってお客様に生じた損害について一切の責任を負いません。
The Company may change or discontinue the Service without notice and shall not be liable for any resulting damages.

第8条（利用規約の変更）/ Article 8 – Changes to Terms

当社は，必要と判断した場合には，お客様に通知することなくいつでも本規約を変更することができます。変更後に本サービスの利用を開始した場合，変更後の規約に同意したものとみなします。
The Company may change these Terms at any time without notice. Continued use of the Service after changes constitutes acceptance of the revised Terms.

第9条（個人情報の取扱い）/ Article 9 – Personal Information

当社は，本サービスの利用によって取得する個人情報については，当社「プライバシーポリシー」に従い適切に取り扱います。
The Company shall handle personal information obtained through the Service in accordance with the Company's Privacy Policy.

第10条（通知または連絡）/ Article 10 – Notifications

お客様と当社との間の通知または連絡は，当社の定める方法によって行います。登録済みの連絡先が有効なものとみなし，発信時にお客様へ到達したものとみなします。
Notifications between the Customer and the Company shall be made by the method determined by the Company. Registered contact information shall be deemed valid, and notifications shall be deemed delivered at the time of sending.

第11条（権利義務の譲渡の禁止）/ Article 11 – Prohibition of Assignment

お客様は，当社の書面による事前の承諾なく，本規約に基づく権利もしくは義務を第三者に譲渡し，または担保に供することはできません。
The Customer may not assign rights or obligations under these Terms to a third party without prior written consent of the Company.

第12条（反社会的勢力の排除）/ Article 12 – Exclusion of Anti-Social Forces

お客様が反社会的勢力またはこれと密接な関係を有する者である場合，当社サービスの利用をお断りします。利用開始後に判明した場合，利用を中止させていただきます。これによって生じた損害について当社は補償いたしません。
The Company shall refuse service to anti-social forces or those closely associated with them. If discovered after use begins, the Company will suspend the Service and shall not be liable for any resulting damages to the Customer.

第13条（準拠法・裁判管轄）/ Article 13 – Governing Law and Jurisdiction

本規約の解釈にあたっては，日本法を準拠法とします。国際物品売買契約に関する国際連合条約の適用を排除します。本サービスに関して紛争が生じた場合には，当社の本店所在地を管轄する裁判所を専属的合意管轄裁判所とします。
Japanese law shall govern these Terms. The UN Convention on Contracts for the International Sale of Goods is excluded. Any disputes shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Company's head office.
